Initial Decisions

Initial Decisions are issued by an Administrative Law Judge (ALJ) following an evidentiary hearing. Both parties may appeal an Initial Decision to the State Personnel Board. Upon review, the Board may adopt the findings of fact and conclusions of law in the Initial Decision; the Board may adopt the findings of fact in the Initial Decision but reverse on one or more conclusions of law; or the Board may reverse the Initial Decision's findings of fact and conclusions of law. If neither party appeals an Initial Decision, it is considered the final order of the Board.

This page compiles Initial Decisions issued by Administrative Law Judges, provided in the PDF file format. Beginning with Fiscal Year 2015-16, all Initial Decisions issued within that fiscal year are listed. Prior decisions are listed by the year assigned in the case number (e.g. "2014G000"), not the year in which the Initial Decision was actually issued. 

Note that the Board Rules and governing statutes change from time to time. In addition, the Colorado Supreme Court and the Colorado Court of Appeals both issue decisions that control subsequent Initial Decisions. Moreover, the Board may reverse an Initial Decision's conclusions of law. Therefore, you should carefully research whether any Initial Decision that you rely upon continues to have any persuasive value.
